Terms of Service

These terms govern your clinic's use of Deq. They are written to be read: short sections, plain language, and a summary where the legal wording gets dense. If anything is unclear, ask us before you sign.
The agreement
By creating a Deq account or signing an order form, your clinic agrees to these terms. The agreement is between Deq and the clinic as an organisation — individual staff accounts are covered by it, not party to it. If you signed an order form, its terms win wherever the two disagree.
The service
Deq is practice software: scheduling, patient records, messaging, and billing, delivered as a subscription. We host it, keep it running, and keep it current. What the product does in detail is described on the product page, not fixed in this document — features evolve; the commitments below do not.
Accounts and access
Your responsibilities
The clinic decides who gets an account and with what role. Keep credentials personal — shared logins make the audit trail worthless, and the audit trail protects you. Tell us promptly when someone leaves.
Ours
Every access to a patient record is logged with who, when, and what. Role changes take effect immediately. We never access your clinic’s data except to provide support you asked for, and every such access appears in the same log you can read.
Patient data
The clinic is the controller of patient data; Deq is a processor acting on the clinic’s documented instructions. In particular:
- Patient data is stored encrypted, in the region named on your order form, and never leaves it.
- No patient data is used to train or evaluate machine-learning models, ours or anyone's.
- Export is self-serve: full records in FHIR and CSV, documents as PDF, at no charge, at any time.
- On termination we hold your data for 90 days for export, then delete it and certify the deletion.
Acceptable use
Use Deq for running a clinic. Don’t probe or overload the service, resell access, or use it to send messages patients haven’t consented to receive. We may suspend accounts that put other clinics’ data or the service at risk — suspension first, conversation immediately after.
Fees and term
Subscription fees are per practitioner per month, set on your order form. Fees change at most once a year, with notice before your renewal. Leaving is deliberately easy:

Availability and liability
We target 99.9% monthly availability and publish our status page openly. The service is provided as-is beyond the commitments in this document; our total liability in any twelve months is capped at the fees you paid in those twelve months. Nothing here limits liability that can’t lawfully be limited.
Changes and contact
When these terms change, we email every clinic administrator at least 30 days before the new version takes effect, with a diff — not a notice that “terms have changed”. Questions go to legal@deq.health; we answer them ourselves.
